On 9th March 2017, the Hong Kong Law Society's Academy of Law held its inaugural conference on Cross-Border Insolvency.
A panel consisting of keynote speaker Mr Justice Jonathan Harris, offshore litigation lawyer Ian Mann, and Hong Kong Barrister Victor Joffe QC discussed the following topics:
- Recognition of offshore insolvency practitioners in the Hong Kong Court;
- The Judicial Insolvency Network Guidelines;
- "Sling-shotting" modern offshore restructuring law into Hong Kong. An exciting addition to the panel was the video contributions from judges of the major offshore jurisdictions of the BVI, the Cayman Islands and Bermuda.
The judicial contributions were graciously received from: Justice Barry Leon, Commercial Court Judge of the British Virgin Islands Chief Justice Ian Kawaley, Supreme Court of Bermuda Justice Anthony Smellie, Chief Justice of the Cayman Islands The involvement of different jurisdictions ensured an interactive, diverse and engaging panel sharing noteworthy content. Justice Barry Leon of the Commercial Division of the BVI High Court spoke by video on the Judicial Insolvency Network’s recent “Guidelines for Communication and Cooperation Between Courts in Cross-Border Insolvency Matters”, designed to improve the efficiency and effectiveness of cross-border insolvency and restructuring proceedings. Chief Justice Ian Kawaley of the Bermuda Supreme Court spoke of the flexibility of the Bermuda provisional liquidator as a restructuring tool that could then be recognized, if appropriate, by a Hong Kong Court. Chief Justice Anthony Smellie of the Grand Court of the Cayman Islands spoke by video citing recent cases of cross border insolvency co-operation between the courts of the Cayman Islands and Hong Kong.
