Not in (Asia) Private: Court supervision of a solvent voluntary liquidation

The Grand Court’s recent decision in Re Asia Private Credit Fund Limited (In Voluntary Liquidation) (unreported, 19 March 2019) considered a successful application under section 131 of the Companies Law to bring the voluntary liquidation of a company under the Court’s supervision notwithstanding the company’s solvency.

Cayman Islands Court of Appeal upholds Restraint Order granted at the request of the US Department of Justice

In Kelvin Leach & Ors v DPP, the Cayman Islands Court of Appeal dismissed an appeal against the decision of Justice Quin not to discharge an ex parte restraint order, freezing accounts connected to alleged US securities fraud. The restraint order was made following a request for mutual assistance by the USDOJ.

Enforcing Foreign Judgments in Cayman no futile exercise

The question as to whether it is proper for the Grand Court of the Cayman Islands to grant leave to serve proceedings out of the jurisdiction in respect of a claim to enforce a foreign judgment under GCR Order 11, Rule 1(1)(m) was re-examined earlier this month by Justice Kawaley in the case of Gayhart & Buchanan v Schanck.
