Expertise and Professional Background

Andrew Thorp is a partner in our litigation department.  He joined Harneys in 2005 from the dispute resolution department of a city firm and advises on a wide range of multi-jurisdictional commercial and insolvency matters on behalf of major international law firms, banks, in-house legal teams, investment funds and trust companies.
  
Andrew is well known for his cross-border work and has a particular interest in international asset tracing and preservation. Much of his focus is on pre-emptive remedies including freezing orders, provisional liquidator appointments and discovery orders, often against a background of fraud.
 
He has been instructed on successful asset retrieval matters across Asia, the CIS and South America on behalf of various banks and insolvency professionals.
  
Since the onset of the Global Financial Crisis, Andrew has been at the forefront of developing insolvency law in the BVI. He successfully led the legal teams in the cases of Barfield Nominees v Westford Special Situations Fund Limited and Aris Multi-Strategy Lending Fund Ltd v Quantek Opportunity Fund, Ltd that have set the BVI apart and defined the status of creditors and the ability of hedge funds to continue in the face of illiquidity.
 
Andrew recently pioneered a number of cross-border protocols between court appointed officers and has advised on restructuring and corporate rescue procedures.
 
Andrew has authored a number of journals and textbook chapters, including “Asset Tracing in the BVI”.

Andrew is the current RISA Chairman of the Board. RISA is the BVI affiliate arm of INSOL, the global association of restructuring and insolvency professionals. Its membership extends globally and its primary responsibilities lie in a liasion between government bodies and the profession and continuing education for the jurisdiction globally.  He has also been recently listed in the international Who's Who of Asset Recovery Lawyers 2012.
