CSSF on SFDR special accelerated procedure

On 5 February 2021, the Commission de Surveillance du Secteur Financier (CSSF) issued a press release as a reminder that UCITS management companies and alternative investment fund managers will have to comply with Regulation (EU) 2019/2088 on the publication of information on sustainability-related disclosures in the services sector (SFDR Regulation) on 10 March 2021.

The CSSF published, on 16 December 2020, a Communication on its accelerated procedure in relation to the visa of prospectus/issue documents amended, for the purposes of bringing pre-contractual information into conformity within the Article 6 (3) of the SFDR Regulation for managed funds – this communication can be found here.

CSSF urges UCITS management companies and alternative investment fund managers that the prospectuses/issue documents to be brought into compliance with the SFDR Regulation must be submitted by 28 February 2021 at the latest in order to be able to comply with the deadline of 10 March 2021 of the SFDR Regulation.

The CSSF informs that the letter confirmation of the SFDR special fast-track procedure, has been adapted and it can also be used to support the review of sustainability information included in a prospectus/issuance document submitted outside of the SFDR special fast-track procedure. The updated letter can be found here.
